If a project is FEDERAL FUNDED by the Federal Transit
Administration (FTA), The RTD Small Business Opportunity Office will review
the scope of work and if sub-contracting opportunities exist, a DBE goal
will be assigned.
NOTES:
- The type of work and the number of sub-contractors used to meet the
DBE goal is at the discretion of the prime contractor.
- If any of the DBE businesses selected as sub-contractors are suppliers,
only 60% of the contract value may be applied toward the DBE goal. Their
supplier status must be indicated in Enclosure 2.
- Any certified DBE business selected for award of a contract as the
prime contractor meets the DBE goal. However, RTD still encourages you
to consider using DBE businesses for your subcontracting needs.
- In order for a business to qualify as a DBE they must have a CURRENT
certification from one of the following programs:
- DBE certification from the Colorado Department of Transportation
(CDOT)
- DBE certification from the City & County of Denver Mayor's Office
of Contract Compliance (MOCC).
No other certifications will be accepted!
- A current copy of the businesses certification for subcontracted DBE
businesses must be submitted with enclosure 1A or 1B. If the prime contractor
is a certified DBE, they must submit a current copy of their certification
with enclosure 1B.

to submitting your bid/proposal if you have any questions regarding the
current certification
status of the businesses you plan to partner with. On-line sources if
DBE business information from RTD, MOCC, CDOT and the SBA are provided
below.
INSTRUCTIONS FOR ENCLOSURES
Complete and return with the bid:
- Enclosure 1A DBE Affidavit.
- Enclosure 1B DBE Affidavit.
- Enclosure 2 - Schedule of DBE Participation.
- Enclosure 3 - Letter of Intent to Perform as a Subcontractor
- Enclosure 5 - Employer Certification of Workforce.
- Enclosure 6 - Solicitation Statistics - for the prime and all sub-contractors
Enclosures 3, 5, and 6 may be submitted up to 48 hours - two working days
- after bid opening date. The 3 low bidders will be contacted to supply
these Enclosures before final bid approval can be made.
IF YOU DO
NOT MEET THE ASSIGNED DBE GOAL, COMPLETE THE FOLLOWING AND SUBMIT
WITH THE BID/PROPOSAL:
- Enclosure 4 - DBE Unavailability
In addition to Enclosure 4, include the following information
as applicable to further determine good-faith efforts:
- Phone logs - number, date and time called, contact, topic, results
- Fax Logs - number, date and time called, re-call date and time, contact,
topic, results
- Notarized copies of all ads run including - publication name, when
run, results
- Names of organizations contacted - organization, when contacted, contact,
topic, results
- Results of all bids received - listed by category
If your bid/proposal does not meet the assigned goal, your submission
of the above information with Enclosure 4 will be your only opportunity
to provide good faith effort information. THE
SMALL BUSINESS OPPORTUNITY OFFICE WILL USE ONLY THE INFORMATION YOU INITIALLY
SUPPLY TO MAKE ITS FINAL DETERMINATION AS TO YOUR GOOD FAITH EFFORTS.
YOU WILL HAVE NO ADDITIONAL OPPORTUNITY TO SUBMIT GOOD-FAITH INFORMATION!
