SBE Program Information

If a project is locally funded (by Colorado State tax revenue), the RTD Small Business Opportunity Office will review the scope of work and if sub-contracting opportunities exist, an SBE availability will be assigned.

NOTES:

This SBE availability applies only to the portion of work the prime contractor plans to subcontract

  1. The type of work and the number of sub-contractors used to meet the SBE availability is at the discretion of the prime contractor.

  2. If the prime contractor does not plan to sub contract any work, there is no SBE availability.

  3. If any of the certified DBE / SBE businesses selected as sub-contractors are suppliers, only 60% of the contracted product value may be applied toward the SBE availability. Their supplier status must be indicated in Enclosure 2.

  4. If the business selected for award of a contract as a prime contractor is also a DBE / SBE business, the SBE availability still applies.

  5. In order for a business to qualify as a certified DBE / SBE they must have a CURRENT certification from one of the following programs:

    • DBE certification from the Colorado Departments of Transportation (CDOT) or the City & County of Denver Mayor's Office of Contract Compliance (MOCC)
    • SBE certification from the COC or the MOCC
    • 8a, SDB or HUB ZONE certification from the Small Business Administration (SBA)
    • ESB certification from the Colorado Department of Transportation (CDOT)
    • DBE or SBE certification from any out-of-state government-certifying agency.

      No other Certifications will be accepted!

A current copy of the certification certificate for subcontracted DBE / SBE businesses must be submitted with Enclosure 3. If the prime contractor is a certified DBE / SBE, They must submit a current copy of their certification certificate with Enclosure 2.

Contact RTD Small Business Opportunity Office at (303) 299 - 2111 prior to submitting your bid if you have any questions regarding the current certification status of the businesses you plan to partner with. On-line sources of DBE / SBE business information from RTD, MOCC, CDOT and the SBA are provided below.

INSTRUCTIONS FOR ENCLOSURES

If you are not subcontracting for this project, complete and return with the bid:

  • Enclosure 1A - SBE Affidavit.
  • Enclosure 1B - SBE Affidavit.
  • Enclosure 2 - Schedule of SBE Participation.
  • Enclosure 3 - Letter of Intent to Perform as Subcontractor.
  • Enclosure 5 - Employer Certification of Workforce.
  • Enclosure 6 - Solicitation Statistics - for the prime and all Sub-Contractors.

If you are sub-contracting and meet the assigned SBE availability, Enclosures 2, 3, and 5 (for sub-contractors) may be submitted up to 48 hours - two working days - after bid opening date. The 3 low bidders will be contacted to supply these Enclosures before final bid approval can be made.

  • Enclosure 2 - SBE/DBE Affidavit with copies of applicable certifications
  • Enclosure 3 - Designation of Subcontractors
  • Enclosure 5 - Solicitation Statistics - for all subcontractors

IF YOU DO NOT MEET THE ASSIGNED SBE AVAILABILITY, COMPLETE THE FOLLOWING AND SUBMIT WITH THE BID:

  • Enclosure 4 - SBE / DBE Unavailability Certification

In addition to Enclosure 4, include the following information as applicable to further determine good-faith efforts:

  • Phone logs - number, date and time called, contact, topic, results
  • Fax Logs - number, date and time called, re-call date and time, contact, topic, results
  • Notarized copies of all ads run including - publication name, when run, results
  • Names of organizations contacted - organization, when contacted, contact, topic, results
  • Results of all bids received - listed by category

If your bid does not meet the assigned SBE availability, your submission of the above information with Enclosure 4 will be your only opportunity to provide good faith effort information. THE SMALL BUSINESS OPPORTUNITY OFFICE WILL USE ONLY THE INFORMATION YOU INITIALLY SUPPLY TO MAKE ITS FINAL DETERMINATION AS TO YOUR GOOD FAITH EFFORTS. YOU WILL HAVE NO ADDITIONAL OPPORTUNITY TO SUBMIT GOOD-FAITH INFORMATION!

Use the following abbreviations in filling out Enclosure 3:

Status: DBE - certified minority/woman owned company
SBE - certified small business enterprise
NON - not certified as a DBE or SBE
   
Ethnic Background: AP - Asian Pacific
AI - Asian Indian
BA - African American
HA - Hispanic
NA - Native American
WF - White Female
WM - White Male
Other - Person who does not fall into above groups
