RTD Contactless Payments Terms and Conditions
Definitions and descriptions
Thank you for using the (“RTD”) service.
These terms and conditions will govern the purchase and use of Tap-n-Ride tickets via Contactless Payment and used on any RTD service. Contactless Payments are provided by Masabi LLC (“Masabi”). RTD and Masabi may modify the terms and conditions relating to Contactless Payments at any time by posting revised terms and conditions. This will not affect any existing terms accepted by you when making earlier token purchases via a Contactless Payment. When purchasing a token by Contactless Payment, you are also agreeing to be bound by these terms. A ‘token’ refers to a type of fare media, including contactless payment cards, which identifies your account and is valid for use on RTD service.
Contactless Payments
Contactless Payments can be used for payment if your financial institution’s bank card, prepaid bank card or mobile phone is enabled to conduct Contactless Payments. Contactless Payments are pay as you go, and regular published fare rates apply to these transactions (subject to change). RTD is not responsible for any additional fees associated through the use of Contactless Payments. RTD makes no guarantee that any financial institution bank cards, prepaid bank cards or mobile phone payments will be accepted.
The appropriate fare must be paid for at the fare validator. RTD is not responsible for any refunds or credits as a result of card clashing. Card clashing happens when you accidently touch more than one bank card on the payment reader at the same time. You must keep your Contactless Payment cards away from each other when utilizing the payment reader to ensure the correct fare is paid. The “correct fare” is defined as paying no more than the published RTD fare for your journey at the time of transaction(s). In order to pay the right fare, you must also use the same card when paying fare at the payment reader. RTD is not responsible for any refunds or credits as a result of you using multiple payment methods.
The security of your bank card and accounts are your responsibility. RTD assumes no responsibility for any damaged, lost or stolen bank cards. RTD will not provide a duplicate or replacement bank card.
You may be asked to show your token (bank card) to an Inspector or any member of staff employed by the RTD or local transit police. The token must be retained during your entire trip on an RTD vehicle. Failure to show a valid token is considered fare evasion and is subject to enforcement actions according to RTD policy and Colorado laws. If you are unable to show a valid token, you may be subject to a fine or other enforcement action.
RTD reserves the right to refuse travel on invalid stolen tokens. Tokens are not transferable and may only be used by you and may not be shared, and tokens do not give you priority over other passengers.
Your RTD token transaction will be facilitated via the RTD’s partner, Masabi. It is RTD that provides these services to you under a token and in no event will Masabi be responsible for or have any liability to you in relation to these services or their availability or performance (including your use or access to any RTD service, the RTD network, your use of any services provided under a token or for your use of the App).
Each rider who makes a Contactless Payment creates a contract with RTD for transport services. RTD hereby indemnifies Masabi for any liability to you in relation to these services or their availability or performance (including any use or access to any RTD operated vehicle, the RTD network, any use of any services provided via a Contactless Payment). RTD has the right, at its sole discretion, to suspend access to a using Contactless Payments at any time and for any reason, with or without notice. Except when RTD suspects fraudulent activity or believes that a rider is seeking to access or use Contactless Payments other than in accordance with these Terms, RTD will use reasonable efforts to only suspend access when carrying out maintenance on the MyRide App, or Masabi’s systems for supporting it.
If you violate these Terms or any policies or guidelines posted on https://rtd-denver.com/, then RTD shall have the right to immediately terminate your access or block Contactless Payments accounts. RTD reserves all of its other rights at law and in equity.

Changes, Refunds and Replacements
All refund requests will be reviewed on a case by case basis. In general, Contactless Payments cannot be changed, cancelled, or refunded except under very special circumstances. The decision to change, cancel or refund a Contactless Payment is made at RTD's sole and absolute discretion. You can submit a request for a refund by calling RTD Customer Care Department at (303) 299-6000. Please note that where a refund is made it shall be for the Contactless Payment price only. Any other associated fees are non-refundable. Neither RTD nor Masabi shall be obliged to refund a Contactless Payment when RTD has reason to believe that the circumstances prompting the refund is the result of fraud.
Liability Disclaimer
In no event will RTD be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to the Web Portal, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise. In no event will Masabi be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of or in connection with your Contactless Payment, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise. Nothing in these terms and conditions shall exclude or limit a person’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.
RTD is a statutory political subdivision of the State of Colorado and is subject to the Colorado Governmental Immunity Act, C.R.S. § 24-10-101, et seq. Nothing in these terms and conditions shall be construed as an express or implied waiver by RTD of its governmental immunity including limitations of amounts, types of liability, or governmental acceptance by RTD of liabilities arising as a result of actions which lie in tort or could lie in tort in excess of the liabilities allowable under the Colorado Governmental Immunity Act.
Legal Responsibility
Neither Masabi nor any of RTD’s other third party licensors shall have any liability to you arising out of or in connection with a Contactless Payment.
Colorado law applies to these terms and conditions and users agree that any dispute between RTD arising out of or in connection with these terms and conditions are subject to the exclusive jurisdiction of the Denver District Court in Denver, Colorado Courts.
These Terms (as may be amended, updated, or supplemented from time to time) are intended by RTD to set out the entire agreement between RTD and riders with respect to a riders’ Contactless Payment. RTD recommends that you read them carefully to protect your own interests and to ensure that you understand your rights and obligations hereunder. You agree and submit to the exclusive personal jurisdiction and venue of the courts located in Colorado. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
RTD may cease to operate the service at any time, in which case the Contactless Payment will be refunded.
Privacy and Data Collection
When making a Contactless Payment, you acknowledge and agree that both RTD and Masabi will collect and store your debit and/or credit card details.
The collection, use, and security of information obtained from riders are subject to RTD's Privacy Policy, as amended. This policy is consistent with Colorado laws governing an individual's right to privacy and may be amended from time to time, as deemed necessary by RTD. The Privacy Policy is posted on the RTD website at https://www.rtd-denver.com/privacy.
